It is your responsibility to be aware of all terms and conditions detailed below; any usage of this site by yourself is on condition that you agree to abide by all of our terms and conditions and that you guarantee your uploaded files also abide by these rules. Any contravention of these terms may result in your usage of this site being revoked.

All data entered by a 'Seller' (this means YOU) on this site is entirely their own responsibility in terms of content. 'Magic Notes' are not to be held responsible in any way for the content, quality or legality of data uploaded.

All usage of your account, whether by you or a third party will be regarded as your personal use - you are responsible for your own account.

You will not use 'Magic Notes' to publish, distribute, transmit or circulate any unsolicited information, message or content (whether they are for advertising or promotional purpose or otherwise) or any content that is obscene, indecent, seditious, offensive, defamatory, threatening, liable to incite racial hatred, discriminatory, menacing or in breach of confidence.

It is not our policy to exercise any editorial control over or to edit or amend any Content before it is transmitted or made available through the Service. However, you hereby authorise us to amend or delete any Content which is uploaded or otherwise provided by you where any such Content is, in our sole opinion defamatory, in breach of copyright or other intellectual property rights or this Agreement, illegal or otherwise not appropriate to be accessed by or through using the Service.

You agree to indemnify us against any action, liability, cost, claim, loss, damage, proceeding, and/or expense (including legal costs) suffered or incurred by us arising from or which is related to: (i) your use, any Designated Users' use and/or any other person's use of the Service where such person was able to access the Service by using your or a Designated User's username for login and/or password and (ii) any breach or non-observance of any term of this Agreement by you or any Designated User.

Your Personal Data (including, without limitation, the information that you provide on registration, in communications with us and regarding your use of the Service and Value Added Services) is collected and processed as follows and in entering into this Agreement, you agree that we may use your Personal Data for any and all of the following purposes: (a) provision of the Service or Value Added Services to you (b) where requested by you, in order to send you details about goods and/or services from us, our agents or Affiliates or selected third parties that may be of interest to you; (c) where requested by you, to pass your data to selected third parties so that they can send you details about their products and services that may be of interest to you; (d) data matching in order to build up a profile of your interests and use of the Service and/or Value Added Services including for the purposes under paragraphs a to c above; (e) improving of goods and/or services in relation to provisioning of the Service; (f) processing of any benefits owed to you and arising out of or in connection with the Service; (g) analysing, verifying and/or checking your credit, payment and/or status in relation to provision of the Service including by way of consulting with credit reference companies where necessary; (h) processing of any payment instructions, direct debit facilities and/or credit facilities in relation to provisioning the Service or requested by you; (i) enabling the daily operation of your account and/or the collection of amounts outstanding in your account in relation to the Service; (j) enabling us to comply with our obligations to interconnect or other industry practices; (k) where requested by you, keeping you informed of other services we provide; (l) prevention or detection of crime; (m) disclosure as required by law; (n) monitoring your use of the Service, Content and any Value Added Services in order to ascertain compliance with this Agreement; and (o) any other purposes as may be agreed to by the parties from time to time.

You agree that the Personal Data may be disclosed and transferred to countries outside the European Economic Area including, without limitation, to Hong Kong. Such transfers may be to any of our Affiliates, agents, contractors, telecommunications operat ors , any other third parties, including collection agencies, credit reference agencies, security agencies, credit providers or other financial institutions and any of our actual or proposed assignees or transferees of our rights with respect to you for such person to use, disclose, hold, process, retain or transfer for the purposes listed in this paragraph. Any transfers outside of the European Economic Area are conducted in compliance with the provisions of the Data Protection Act 1998.

This Agreement shall commence from the moment that you create your account for the Service and shall continue until terminated via a request in writing (through email) to us, acknowledged by us.

We shall pay you monies owed via PayPal to your designated PayPal account. There is no other method of payment permitted. The monies will be paid on a regular basis; usually monthly. Should you not have a valid PayPal account then we shall accumulate your funds until such time as you do, then we shall release the funds in full.

Any violation of our Terms and Conditions may result in the witholding of funds owed to you.
